Legal Inquiries & Compliance Notice
This page explains what NexaPay does and does not do, and how official, legal and compliance requests are handled.
NexaPay is a software provider based in Tallinn, Estonia. We provide integration tools — a merchant dashboard, a WooCommerce plugin and an API — that connect merchants’ websites with independent payment and crypto providers, each licensed in its own right.
NexaPay DOES NOT offer banking, payment, money-transfer, custody, exchange or crypto brokerage services, or any other regulated financial activity.
NexaPay DOES NOT process payments, hold or move merchants’ or customers’ funds, or keep their digital assets. It is NOT an acquirer, a merchant of record, a payment service provider (PSP), a custodian, a money services business or a financial intermediary in any country.
Nature of Services
- NexaPay’s software exists to let a merchant’s website communicate, through APIs, with independent third-party financial and cryptocurrency providers.
- Every financial transaction is carried out by a third-party provider under that provider’s own licences, compliance programme and risk controls.
- NexaPay takes no part in authorising, clearing or settling payments, holding or routing funds, handling chargebacks or disputes, carrying out regulatory screening of transactions, or approving them.
- Regulatory duties linked to transactions — including KYC, AML, sanctions screening, transaction monitoring and licensing — belong to the provider that executes the transaction.
- Our software is provided “as is”, for interoperability, with no warranty of any kind.
Cryptocurrency & Decentralised Infrastructure
Payouts are made in cryptocurrency, so these transactions take place on public, decentralised blockchain networks. No single party owns these networks — and NexaPay does not own, run, administer or control any of them.
- NexaPay is not a blockchain operator or validator.
- NexaPay never has custody of wallets or their private keys.
- NexaPay has no ability to stop, undo, reroute, retrieve or edit a crypto transaction.
- Once a transfer is confirmed on the blockchain, it cannot be undone.
- Independent third-party providers supply all wallet, payout, exchange and custody infrastructure.
- NexaPay follows a ZERO-CUSTODY MODEL. By design, our systems never generate or handle the seed phrases or private keys of any wallet. Signing transactions, managing keys and running wallet infrastructure are tasks performed solely by independent licensed crypto providers, and merchants receive payouts in self-custodial wallets that only they control. As a result, NexaPay has NO CUSTODY of any kind — sole, joint or indirect — and cannot touch, transfer or authorise the movement of anyone’s digital assets.
Because blockchains are decentralised and their records cannot be altered, NexaPay has NO POWER and NO TECHNICAL MEANS to interfere with a confirmed transaction.
Regulatory & Law Enforcement Requests
NexaPay holds no customer funds, has no control over settlement, has no custody access to digital assets, and does not keep the KYC or AML records that payment providers collect. The information NexaPay does hold is limited to what our Privacy Policy describes — mainly account details, payment and checkout details, support messages and technical logs.
Requests about freezing accounts, seizing or recovering funds, chargebacks, disputes, transaction reversals or providers’ compliance records must be sent to the licensed payment or cryptocurrency provider that carried out the transaction.
Official requests to NexaPay should be sent to [email protected] with the subject line “Legal Request” and should include:
- the name of the requesting authority or organisation and a contact person;
- the legal basis and jurisdiction for the request, with supporting documents (for example, a court order or an official request letter);
- the specific information requested and the accounts, wallet addresses or transaction IDs concerned.
We review properly made requests under Estonian law and any other law that applies. Requests that are informal, incomplete or not made through proper legal channels may not be processed.
Merchant Responsibility
Each merchant that uses NexaPay is fully and solely responsible for running its business lawfully — including any licences it needs, its tax obligations, consumer protection rules and anti-money-laundering requirements in every country where it operates.
NexaPay ACCEPTS NO RESPONSIBILITY and NO LIABILITY for how merchants run their businesses, their compliance or regulatory status, or their financial conduct.
Reporting Illegal Activity
Serious illegal activity is not allowed on NexaPay. If you believe a merchant is using NexaPay for fraud or any other illegal purpose, email [email protected] with the website address, any wallet addresses or transaction IDs involved and a short description. We review every report, and accounts found to be involved in serious illegal activity are deleted and banned under our Terms of Use.
Notice to Third-Party Providers
NexaPay supplies neutral software that lets independent systems connect through APIs. Apart from enforcing our own Terms of Use, we do not supervise, manage or endorse what merchants do with third-party services.
Each provider decides who may use its services. If a provider concludes that a merchant is using its API in breach of its policies, contract terms or compliance rules, it is up to that provider to take the appropriate technical and legal steps — for example, suspending or revoking the merchant’s access, credentials or keys.
Unless a legally binding order says otherwise, enforcing a provider’s internal policies is NOT NexaPay’s role, and NexaPay has NO DUTY to do it on the provider’s behalf. We will, however, review any information a provider shares with us about prohibited activity and act on it under our own Terms of Use. Every provider is responsible for its own access controls, authentication, encryption and other security measures.
Accordingly, a provider’s failure to use its own security tools, contract terms or compliance controls is not something NexaPay can be held liable for.
Copyright & Content Complaints (Including DMCA)
NexaPay provides API integration software as a service. Content on merchants’ websites and other third-party websites is not hosted, stored, cached, indexed or distributed by NexaPay.
Content on websites that use our software is created, published and controlled by those websites’ operators and their hosting providers, not by NexaPay. We therefore have NO TECHNICAL MEANS to take such content down and NO LEGAL POWER to block it.
Copyright complaints, including DMCA takedown notices, about content hosted elsewhere should be sent to the party that hosts or controls that content. Complaints that show no technical or legal connection between NexaPay and the content are treated as misdirected and may go unanswered, and sending one does not create any duty or liability for NexaPay.
If you believe that content on nexapay.one itself infringes your rights, or that a merchant is using NexaPay to sell counterfeit or other illegal goods, please contact us at [email protected].
For the avoidance of doubt, NexaPay acts only as a technical software provider. It is not a payment processor, a custodian of digital assets, a financial intermediary or a host of content. Whoever operates the relevant system, or the third-party provider concerned, bears legal responsibility for content, transactions, compliance and asset custody.
This page should not be read as NexaPay accepting responsibility, control or liability for anything run or published by third parties.
